If your bank account was used to receive money from a cyber fraud, the Gurugram cyber police may call you, serve a notice, or arrest you. Anticipatory bail is the main protection available before arrest. This post explains how it works in mule account cases.

What is anticipatory bail?

Anticipatory bail is a court order, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), that directs the police to release you on bail if you are arrested in a particular case. You apply before arrest. It is heard by the Sessions Court first, and then the Punjab and Haryana High Court if needed.

Who should consider applying?

  • You received a call or notice from a Gurugram Cyber Crime police station.
  • You learned that an FIR names you or your bank account.
  • Your account is frozen and the police are asking you to come in.
  • You gave your account, card or SIM to someone and now fear arrest.

What courts look at in mule account cases

  • Your role. Account holder only, or involved in organising the fraud?
  • Knowledge. Did you know the money came from fraud?
  • The amount. How much passed through your account, and how much was withdrawn or forwarded?
  • Cooperation. Have you joined the investigation when called?
  • Your background. Fixed address, family, job, and any previous cases.
  • Need for custodial interrogation. Whether the police truly need to hold you in custody.

Documents to keep ready

  1. Copy of the FIR or the police notice, if you have it.
  2. Bank statements for the period concerned.
  3. Identity and address proof.
  4. Chats, call records and any payment received for giving the account.
  5. Employment or business proof showing a stable background.

What if the police already arrested me, or arrest a family member?

Common mistakes

  • Waiting until the police are at the door before consulting a lawyer.
  • Giving a detailed statement without understanding how it can be used.
  • Skipping a notice of appearance. This can badly damage a bail application.
  • Assuming that repaying the victim ends the case.

FAQs

Is anticipatory bail guaranteed?

No. It is discretionary, and each case turns on its facts. A lawyer can tell you whether your case is a reasonable candidate, but cannot promise the result.

Can the police arrest me while the application is pending?

Unless the court has granted interim protection, the police are not barred from arresting you. Ask your lawyer whether to request interim protection.

Should I join the investigation after applying?

Yes. Cooperation is one of the factors courts consider.

Does anticipatory bail end the case?

No. It only protects you from arrest in that case. The investigation and trial continue.
