This is one of the most anxiety-inducing questions we hear from clients across Gurugram and the wider Haryana-NCR belt — and understandably so, because an open-ended freeze on your salary or business account can feel like it has no end date at all. Here's what the law actually says, and what happens in practice.

There's No Single Fixed Number

Unlike, say, a bail hearing timeline, there is no single statutory clock that says a bank must unfreeze your account within a fixed number of days. The duration depends on why the freeze was placed:

  1. Police or cyber cell directed freeze under Section 35 of the IT Act or BNSS provisions: these continue as long as the investigation requires, subject to periodic review. In practice, for Gurugram cyber cell cases, this often runs for weeks to a few months, depending on how actively the investigating officer is pursuing the money trail across the, often multiple, banks involved.
  2. Court-ordered freeze or attachment: continues until the court itself vacates or modifies the order — this can run for the duration of trial in serious matters, though interim relief is often possible.
  3. RBI or banking-regulation holds for KYC or suspicious transaction flags: these are typically shorter and resolve once compliance documentation is furnished, though banks sometimes take their own time internally.

Why Gurugram Cases Often Take Longer

Gurugram's cyber crime units handle an unusually high volume of fraud cases relative to most Indian cities, a direct consequence of the region's dense BPO, call-centre, and corporate ecosystem, which unfortunately also makes it fertile ground for fraudulent operations posing as legitimate businesses. This case volume means investigating officers are often managing dozens of active files simultaneously, and a freeze on your account may simply sit in the queue until you, or your lawyer, actively push for review.

Additionally, many freezes affecting Gurugram-based accounts didn't even originate here: a victim in another state files a complaint, traces the money to an account opened in Gurugram, and requests a freeze through inter-state cyber cell coordination. This adds a layer of delay, since the local bank and police often cannot resolve the freeze without word from the originating state.

The Legal Safeguards That Do Exist

While there's no fixed maximum, you are not without options if a freeze appears to be dragging on indefinitely or disproportionately:

  • You can demand a written explanation from the bank as to which authority requested the freeze and under what reference.

  • You can approach the jurisdictional court if the freeze has continued unreasonably without progress in the investigation. Courts, including those in Gurugram's District Courts complex, have in various cases directed release of funds where continued freezing was found disproportionate.   • RBI Ombudsman recourse can also be relevant where the issue is a banking-process failure rather than a genuine investigative hold.

What Determines Whether Yours Will Be Fast or Slow

Whether you're the named accused or simply an incidental recipient of funds, how many banks and accounts the fraud trail runs through, whether the originating complaint is from within Haryana or another state, and how proactively you or your counsel engage with the investigating officer rather than passively waiting — all of these shape the timeline.

A Word on Patience Versus Persistence

There's an important difference between waiting and following up. Genuine progress on freeze-related matters in high-volume jurisdictions like Gurugram tends to come from structured, periodic, well-documented follow-up, not from simply hoping the file moves on its own.
