People in Gurugram often ask us the same first question before hiring an investigator: is it even legal? The short answer is that private investigation as an activity is lawful. The methods are where clients get into trouble.

What is lawful

A private detective can verify identity and credentials, search public and court records, check company filings and property records, interview willing people, observe from public places, and document what can be lawfully seen and recorded. This is the core of a genuine private detective service in Gurugram.

What is not

  • Obtaining call detail records, SMS records or location data without legal authority.
  • Getting into someone's phone, email, social media or cloud account.
  • Installing spyware or tracking apps on another person's device.
  • Obtaining bank statements through contacts inside a bank.
  • Trespassing, impersonating a public servant, or intimidating a witness.

Depending on the facts, these can attract criminal liability under the Information Technology Act, 2000, the Bharatiya Nyaya Sanhita, 2023, and data protection law. The risk does not stop with the detective. A client who instructs or knowingly benefits from an illegal method can be named too.

There is no detective licensing law yet

India does not currently have a central statute licensing private detectives, so there is no official badge to check. That makes it more important to look at how an investigator works: written scope, stated methods, documented sources and a report that separates facts from guesses.

Why legality is also a practical issue

What to do

Ask any investigator, in writing, how they will obtain the information you want. If the answer involves phone records, hacking or "contacts", walk away. If you are unsure, speak to a lawyer first.
