
Filing a First Information Report is the first step in reporting a cognisable offence in Gurugram — theft, assault, fraud and the rest. Understanding the process helps ensure your complaint is recorded properly and that the case actually moves.
What an FIR is
An FIR is the information first given to the police about a cognisable offence, recorded under Section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023. It is not a finding of guilt and it is not a court proceeding. It sets the investigation going, and the sections written into it decide whether the offence is bailable and which court will eventually try the case.
Where to go
Ordinarily the police station in whose jurisdiction the offence took place. If you are unsure, a zero FIR can be registered at any police station and transferred to the correct one — the police cannot turn you away on jurisdiction alone. What to take
- A written complaint, in your own words, dated and signed
- Your identity proof
- Documents supporting the allegation — receipts, messages, photographs, medical papers
- Details of witnesses, if any
The process
- Give your complaint in writing, or state it orally so it can be reduced to writing.
- Read what has been written before signing it. Once signed, it is the version of events on record.
- Ask for the FIR number and take a free copy — you are entitled to one.
- Note the name of the investigating officer and keep his contact details.
If the police refuse to register it
This happens, and there is a defined remedy:
- Send your complaint in writing to the Superintendent of Police, by post, and keep the receipt.
- If nothing follows, apply to the Magistrate under Section 175(3) BNSS for a direction to register and investigate.
- A complaint case under Section 223 BNSS is the alternative route where an FIR is not forthcoming at all.
After the FIR
The investigation follows: statements, seizures, and eventually a chargesheet or a closure report. Where you are the complainant, staying in touch with the investigating officer matters more than people expect. Where the FIR is against you, get a certified copy first — no strategy is possible without the exact sections invoked — and read anticipatory bail next.
