The Legal Framework That Protects You

Several overlapping laws apply to sextortion cases in India:

• Section 66E, IT Act — punishes capturing, publishing, or transmitting images of a person's private area without consent, violating privacy
• Section 67 and 67A, IT Act — punish publishing or transmitting obscene material and sexually explicit material electronically
• Section 308, BNS — extortion, punishable with imprisonment
• Section 351, BNS — criminal intimidation
• Where morphed or deepfake images are involved, provisions relating to forgery and defamation under BNS may also apply

Step 1: Do Not Pay

Paying almost never ends the extortion — it typically confirms to the blackmailer that you are willing to pay, leading to repeated and escalating demands. This is the single most important piece of advice for anyone facing this situation.

Step 2: Preserve Evidence Immediately

Before blocking the blackmailer (which is a natural instinct), take screenshots of:

• The chat or call history showing the threat
• The blackmailer's profile, username, or phone number
• Any payment details they have shared (UPI ID, bank account, wallet address)

Do not delete the conversation even after blocking — this evidence is critical for the investigation.

Step 3: Report Confidentially

You can file a complaint in either of these ways:

• Through the National Cyber Crime Reporting Portal (cybercrime.gov.in) under the "Women/Child Related Crime" category, which has special confidentiality safeguards
• Directly at the Cyber Cell, where officers are trained to handle such complaints discreetly

What Police Investigation Typically Involves

• Tracing the blackmailer's phone number, social media account, or payment details
• Requesting takedown of the content from platforms (Instagram, Facebook, etc.) under Section 79(3)(b) of the IT Act or through direct platform reporting mechanisms
• In cross-border cases, coordinating through Interpol or the platform's law enforcement request channels, which can extend timelines

Getting Content Taken Down Quickly

Apart from the police process, most major platforms have dedicated non-consensual intimate imagery (NCII) reporting tools that can result in faster takedowns than waiting for the criminal process to conclude.
