UPI has made payments instant — which is exactly why UPI fraud has exploded in Gurgaon and across the NCR. Fake QR codes, "wrong" collect requests, impersonation of delivery agents, and fraudulent investment apps are now among the most common cyber complaints filed at local police stations. The question every victim asks is the same: can I actually get my money back?

How UPI Fraud Typically Happens

  • Collect request scams: The fraudster sends a payment collect request disguised as a refund, and the victim approves it without reading carefully, authorizing an outgoing payment instead.
  • Fake QR codes: Scanning a QR code shared by a fraudster (often posing as a buyer on OLX or a similar platform) can trigger a payment rather than a receipt.
  • Screen-sharing app scams: Victims are convinced to install a screen-sharing app for "tech support" or KYC update, allowing the fraudster to see OTPs and PINs.
  • Fake customer care numbers: Searching for a company's customer care number online often surfaces fraudulent numbers that lead to UPI-linked scams.

Is Recovery Actually Possible?

Recovery depends almost entirely on speed and the money's current location:

  • If reported within minutes to hours: There is a reasonable chance the receiving bank can freeze the funds before withdrawal, especially through the 1930 helpline's real-time coordination with banks.
  • If reported after the money has been withdrawn or layered through multiple accounts: Recovery becomes significantly harder, though not impossible — investigation can still trace and, in some cases, attach the fraudster's other assets.
  • If the fraud involved a "mule account": Recovery from the mule account holder directly is possible if the account still holds traceable funds, but this often requires a court order following the FIR.

Immediate Steps After UPI Fraud

  1. Call the National Cyber Crime Helpline at 1930 immediately
  2. File a complaint on cybercrime.gov.in with transaction ID, UPI reference number, and screenshots
  3. Simultaneously inform your bank's fraud reporting cell and request a formal dispute/chargeback where applicable
  4. Visit the nearest police station or Cyber Cell (in Gurgaon, this includes the dedicated Cyber Police Station in Sector 37) to have the complaint converted into an FIR

Filing the FIR: What You Need

To register an FIR for UPI fraud, be prepared with:

  • A written complaint narrating the sequence of events
  • Bank statement highlighting the fraudulent debit
  • Screenshots of any communication with the fraudster
  • The cybercrime.gov.in acknowledgment number, if already filed online

Under the applicable provisions of the Bharatiya Nyaya Sanhita (cheating and criminal breach of trust) read with the IT Act, such cases are cognizable, meaning police are legally obligated to register an FIR without requiring a magistrate's order, provided the facts disclose a cognizable offence.

What If the Police Refuse to Register an FIR?

This happens more often than it should, particularly with smaller amounts. If you face resistance:

  • Submit your complaint in writing and get an acknowledgment of submission
  • Escalate in writing to the Superintendent of Police / DCP under Section 173(4) BNSS
  • If there is still no action, approach the jurisdictional Magistrate under Section 175(3) BNSS, who can direct the police to register the FIR

Civil Recovery as a Parallel Option

Where the fraudster's identity is known but recovery through police channels stalls, a parallel civil recovery suit or a complaint before the banking ombudsman (for disputes involving bank negligence in fraud prevention) can sometimes yield faster financial relief than waiting solely on the criminal process.

Preventing Repeat Incidents

  • Never scan a QR code to "receive" money — QR codes are only for making payments
  • Never share OTPs, UPI PINs, or install screen-sharing apps at a stranger's request
  • Verify customer care numbers only through official app or website channels, never through search engine results
